The individual is legally blind or has a medically determinable physical or mental impairment, which results in marked and severe functional limitations, and which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.

The individual may open an account independently if they are over the age of 18 and have the capacity to enter an agreement. If the individual cannot, or would prefer to have assistance, an individual selected by the Beneficiary, or the eligible individual's agent under a power of attorney, conservator or legal guardian, the spouse, a parent, a sibling, a grandparent, or a representative payee (whether an individual or organization) appointed by the Social Security Administration (SSA), can open an account on their behalf.
